Judicial Overreach in the Proposition 4 Redistricting Ruling

The Cache County Republican Party steadfastly upholds our constitutional republic, grounded in representative government, the principle of separation of powers, and the solemn oaths of office undertaken by public servants. We assert that each branch of government bears a critical responsibility to safeguard its authority, ensuring equitable processes and preventing any encroachment.
The recent judicial ruling concerning Proposition 4 and congressional redistricting authority represents a clear violation of both the U.S. and Utah Constitutions. The court has disregarded the legislature’s explicit constitutional mandate to draw maps (Utah Const. Art. IX, §1; U.S. Const. Art. I, §4) and has further deviated from Prop 4’s established framework by arbitrarily adopting a plaintiff-submitted map lacking legal or voter derived legitimacy.
When one branch of government fails in its duty, the others are both morally and constitutionally compelled to restore balance and justice.
Governor Spencer Cox has appropriately affirmed the legislature’s sole authority under the Utah Constitution to delineate congressional districts. We respectfully urge Lieutenant Governor Deidre Henderson to uphold this position.
Article I, Section 2 of the Utah Constitution grants the people the right to reform and alter their government within established guidelines and procedures; however, this provision does not empower unelected NGOs or courts to undertake map-drawing responsibilities. The most principled course of action is for the Lieutenant Governor, guided by her oath and the doctrine of separation of powers, to reject the unauthorized, court imposed map and reinforce the legislature’s constitutional role.
The Cache County Republican Party advocates for representative government, opposing judicial activismand undue external influence. The citizens of Utah deserve redistricting maps crafted by their elected representatives, not dictated by lawsuits or special interests
